Terms of Service

These Terms of Service (“Terms”) govern your access to and use of The Shooting Lab’s (“Company,” “we,” “our,” or “us”) website, services, and mobile arcade offerings. By accessing or using our website or services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Use of Services

  • You may use our services only in compliance with these Terms and all applicable laws.
  • You agree not to misuse our services or interfere with their normal operation.
  • We reserve the right to refuse service, suspend, or cancel bookings that violate these Terms or are otherwise harmful.

2. Eligibility & Age Restrictions

By accessing our website, booking our services, or opting into SMS communications, you represent and warrant that you are at least 18 years of age. Our platforms, event bookings, and communications are strictly directed to individuals who are 18 and older.

3. Bookings & Information

  • When you provide information to us for a quote or booking, you agree that it is accurate, complete, and up to date.
  • You are responsible for communicating any changes to event details promptly.

4. Payment & Billing

  • Fees for our mobile arcade services and event packages will be disclosed before purchase or booking confirmation.
  • Payments are due according to the agreed schedule. Late or failed payments may result in cancellation of services.
  • All fees are non-refundable unless otherwise agreed in writing or outlined in your specific rental agreement.

5. Intellectual Property

All content, materials, and intellectual property provided by The Shooting Lab (including but not limited to hardware designs, branding, and written materials) remain the exclusive property of The Shooting Lab or its licensors. You may not copy, distribute, modify, or create derivative works without our prior written consent.

6. Client Content & Data

  • You retain ownership of any content or event data you provide to us.
  • By providing content or data, you grant The Shooting Lab a limited license to use it solely for the purpose of delivering our services.
  • You are responsible for ensuring that your content and data do not violate any laws or third-party rights.

7. Third-Party Services

Our services may integrate with or rely on third-party platforms or tools (such as payment processors). By using our services, you also agree to comply with the terms and policies of such third parties. We are not responsible for the actions or failures of third-party services.

8. Limitation of Liability

  • Our services are provided “as is” and “as available.” We make no warranties, express or implied, regarding accuracy, reliability, or fitness for a particular purpose.
  • To the maximum extent permitted by law, The Shooting Lab is not liable for any indirect, incidental, or consequential damages resulting from your use of our services or participation in our arcade games.
  • Our total liability for any claim related to our services will not exceed the amount you paid to us in the 12 months prior to the event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless The Shooting Lab, its officers, employees, and partners from any claims, damages, liabilities, costs, or expenses arising from your misuse of our services, accidents during self-run gameplay, or violation of these Terms.

10. Termination

We may suspend or terminate your access to services or cancel an event booking at any time for violations of these Terms or if necessary to protect our business, staff, and equipment.

11. Governing Law

These Terms shall be governed by and construed under the laws of the State of Florida, without regard to conflict of law principles.

12. SMS / Text Messaging Terms

By opting in to receive SMS text messages from The Shooting Lab, you agree to the following terms:

  • Program Description: We send text messages to opted-in users for transactional purposes (e.g., quotes, event bookings, and customer support alerts) as well as promotional purposes (e.g., launch updates, surveys, and special announcements).
  • Cancellation: You can cancel the SMS service at any time. Just text "STOP" to the number from which you received the message. After you send the SMS message "STOP", we will send you a final message confirming that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time.
  • Help: If you are experiencing issues with the messaging program, you can reply with the keyword "HELP" for more assistance, or you can get help directly by emailing [email protected] or calling (941) 413-2621.
  • Carrier Liability: Carriers are not liable for delayed or undelivered messages.
  • Message & Data Rates: As always, standard message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your interactions and event schedule. If you have any questions about your text or data plan, please contact your wireless provider.
  • Privacy: For privacy-related inquiries, please refer to our Privacy Policy.

13. Changes to Terms

We may update these Terms from time to time. Continued use of our services after changes take effect constitutes your acceptance of the revised Terms.
